Terms & Conditions
The rules for accessing KernelNest Labs, ordering digital products and accepting a delivery boundary.
Last updated: August 21, 2026. These terms apply to the KernelNest Labs website, customer accounts, storefront orders and manually delivered digital services.
1. Acceptance and eligibility
By using this website, creating an account or placing an order, you agree to these terms and the linked Privacy and Refund Policies. You must have legal capacity to contract and authority to act for any organisation named in the order.
2. Website access and acceptable use
KernelNest Labs grants a limited, revocable, non-transferable right to use the website for lawful evaluation and purchasing. You must not interfere with the service, probe systems without permission, introduce malicious code, scrape protected content, misuse accounts, evade payment or use the service to violate another person’s rights.
3. Products, scope confirmation and delivery
Store products are starting boundaries for digital backend work. Checkout records the order; it does not authorize unlimited work. Before implementation, KernelNest Labs confirms the required inputs, exclusions, one acceptance condition, access path and delivery method. Material scope changes may require a revised product, price or timeline.
4. Prices, payment and taxes
Prices are shown in the storefront currency and may change for future orders. Final taxes and available payment options may depend on the customer’s location and are shown during checkout. You are responsible for accurate billing details and authorised payment. Failed or disputed payments may pause delivery.
5. Your responsibilities
- Provide accurate context, lawful access and a responsive technical contact.
- Maintain backups and avoid sending secrets through ordinary forms or email.
- Confirm that you have rights to the code, data, credentials and third-party services supplied for the work.
- Review the agreed acceptance condition and report a material issue promptly.
6. Intellectual property and licence
Pre-existing materials, tools, open-source components and third-party assets remain subject to their existing ownership and licences. Unless an order states otherwise, after full payment KernelNest Labs grants the customer the rights necessary to use the custom deliverable for its intended business purpose. Brand assets, site content and general reusable know-how are not transferred.
7. Warranties and availability
Services are provided with reasonable care against the written boundary, but software and third-party systems can fail. Except where law does not allow exclusion, the website and general content are provided without promises of uninterrupted availability, fitness for every purpose or compatibility with future third-party changes.
8. Liability
To the maximum extent allowed by law, neither party is responsible for indirect, incidental, special or consequential loss arising from use of the website or a delivery. KernelNest Labs’ aggregate liability relating to an order is limited to the amount paid for that order, except where liability cannot legally be limited.
9. Suspension, termination and updates
Access or work may be suspended for unsafe access, abuse, non-payment, unlawful instructions or a material breach. Clauses intended to survive termination remain in effect. Terms may be updated for future use of the service, with the revised date shown here.
10. Law, disputes and general terms
The laws applicable to the KernelNest Labs contracting entity identified in the order confirmation govern these terms, subject to mandatory consumer protections. If one clause is unenforceable, the remaining terms continue. Delay in enforcing a right is not a waiver. These terms and the confirmed order boundary form the agreement for the purchased service.
